ORDER

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.468 of 2016 on the file of II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate at Kukatpally, Ranga Reddy District.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor representing the State.

3. It is represented that the petitioners/A1 to A3 were shown as absconding in the charge sheet and consequently issuance of warrants were sought for.

4. In view of the allegations in the charge sheet, this is not a fit case where the proceedings against the petitioners can be quashed.

5. Hence, the Criminal Petition is disposed of, with the following directions: i) The petitioners/A1 to A3 are directed to appear before the trial Court within thirty (30) days from today and file an application under Section 70(2) Cr.P.C., for recalling of NBW pending against them. On filing such an application, the trial Court shall consider the same on merits and dispose of the same in accordance with law on the same day. ii) The learned II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate at Kukatpally, Ranga Reddy District, is directed to dispose of C.C.No.468 of 2016, within a period of six(6) months from today, without insisting on the presence of the petitioners/A1 and A3 herein on each and every date of hearing. Petitioner No.2/A2 shall appear before the trial Court.

6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
