R. Chandra Sekhar, v. The Greater Hyderabad Municipal Corporation, Rep.By Its
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18134 of 2016 ORDER:
Heard learned counsel for the petitioner and Sri Chatla Madhu, learned Standing Counsel appearing for Greater Hyderabad Municipal Corporation.
The present Writ Petition came to be filed questioning the action of the respondents 1 and 2 in not laying the road between Plots No.15 and 16 in Sy.No.25, Shivanagar colony, Jonnabanda, Alwal, as illegal and contrary to the provisions of G.H.M.C. Act and consequently direct the respondents to lay the road in between Plots No.15 and 16 in Sy.No.25.
Though various grounds are raised, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation made on 29.05.2016 requesting to lay a road in between Plots No.15 and 16 in Sy.No.25, Shivnagar colony, Jonnabanda, Alwal, as early as possible. It is the case of the petitioner that due to illegal interference by the landgrabbers, the authorities are not laying the road and taking advantage of the inaction of the G.H.M.C. authorities, the 3rd respondent is trying to encroach onto the road. However, he submits that his representation may be directed to be considered at the earliest.
Having regard to the facts and circumstances, the respondents are directed to consider the representation dated 29.05.2016 made by the petitioner, as early as possible
preferably within a period of four weeks from the date of receipt of the order, in accordance with law.
With the above direction, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR Dt:09.06.2016 GM
