HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 39331 of 2012 Order:

This writ petition was filed for the following relief. "Writ of Mandamus directing the first respondent i.e., Government of Andhra Pradesh (i) Not to interfere with the functioning of the Andhra Pradesh Public Service Commission as ordained by Articles 315 and 320 of the Constitution of India by declaring the GO Ms. No.420, dated 22.07.2011, GO Ms.

Nos.622 and General Administration (Service) Department, dated 13.12.2012 and all other consequential notifications as unconstitutional and illegal, (ii) To direct the Government of Andhra Pradesh to issue only instructions as required under Regulation 14-A and not directions, (iii) To declare that the 2nd respondent shall act as part of the Commission on the basis of democratic functioning of the Commission and not at the directions of the Government, and (iv) To direct the 3rd respondent to function as Secretary to the Commission and not as Secretary to the Government."

2. When the Writ Petition was filed no interim order was granted. Subsequently, petitioners 1 to 4 and 6 withdrew the Writ Petition. Only the 5th petitioner remained on record and he stated to be a member of Andhra Pradesh Public Service Commission, Hyderabad.

Consequent to the bifurcation of the State, there is change in the constitution of the Public Service Commission also. In view of the same, nothing survives for adjudication in the present Writ Petition and the matter has become infructuous.

3. The Writ Petition is, accordingly, dismissed as infructuous. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending

in this Writ Petition shall stand closed.
