HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.37284 OF 2018 ORDER:

Challenging the order, dated 10.02.2018, in File No.D1/4726/2016, passed by the Joint Collector, Ranga Reddy District/2nd respondent, wherein the implead petition filed by the petitioner was dismissed without assigning any reason, the present Writ Petition came to be filed.

Learned counsel for the petitioner mainly seeks to set aside the order under challenge on the ground that the same is bereft of any reason.

It would be appropriate to extract the impugned order, which reads as under:

"Case called. Counsel for RP present and requested to dismiss the implead petition. Counsel for respondent No.2 to 5 present also requested to dismiss the implead petition. Counters have been filed on IP by the RPs and respondent No.2 to 5. The implead petitions dismissed. The respondent is directed to file the counter in main case in 2 weeks. NDH 03-03-2018."

From a reading of the impugned order, it appears that no reasons are assigned as to why the implead petition has been dismissed.

Hence, the impugned order, dated 10.02.2018, is set aside and the matter is remanded back to the Joint Collector, Ranga Reddy District/2nd respondent, directing the 2nd respondent to pass a reasoned order, in accordance with law, after hearing the implead petitioner and all the concerned.

Accordingly, the Writ Petition is allowed. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
