HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 27233 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 45 of Yepur Village, Rapur Mandal, SPSR Nellore District. It appears that the fair price shop of the petitioner was inspected by the Mandal Revenue Inspector on 8.7.2015 and certain irregularities were noticed. Based on the report submitted on 15.7.2015 pursuant to the said inspection, the third respondent issued show cause notice cum suspension of authorization on 24.7.2015. Challenging the same, the present Writ Petition is filed.

As many as four charges are levelled against the petitioner. Charge No.1 relates to variation in the stock whereas as other charges are technical in nature. In respect of first charge also, there was variation of 15 Kgs of rice and 12.5 Kgs of sugar. The said quantities are minor when compared to the ground stock. In the circumstances, the order of suspension against the petitioner is not warranted. Accordingly the order of suspension dated 24.7.2015 is set aside. However, the third respondent is at liberty to conduct enquiry in respect of the irregularities levelled against the petitioner and pass final order thereon within a period of three months from the date of receipt of a copy of this order after giving due opportunity to the petitioner.

Subject to the above the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
