HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 7 3 8 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Sabbavaram Police Station, Visakhapatnam District, dated 31.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the representation No.4 Station House Officer, Sabbavaram Police Station, Visakhapatnam District, had received the petitioner's complaint through the registered post on 07.07.2018, wherein he stated that he is having land under Sy.No.87/ 4, admeasuring cents, Sy.No.87/ 16, admeasuring 6 cents, Sy.No.

87/ 19, admeasuring 7 cents (total 17 cents) situated at Gullepalli village and when the petitioner tried to construct compound wall around tsaid lands, one Cheepurupalli Demudamma, Cheepurupalli Nageswara Rao, Cheepurupalli Lakshmi, Singampalli Rupra, Singampalli Jitendra, Gandi Lakshim, Sabbavarapu eswar Rao, Sabbavarapu Srinivasa Rao, Sabbavarapu Nagamani, Sabbavarapu Lakshmi, Sabbavarapu Kiran, Gandi Gangamma, Cheepurupalli Nagesh, Cheepurupalli Lavanya and Gandi Govinda came to the petitioner's land and obstructed not to construct the compound wall.

It is submitted that pursuant to the complaint of the petitioner, the respondent No.4 Station House Officer, Sabbavaram Police Station, Visakhapatnam District, had enquired into the complaint and revealed that the lands of the petitioner is under civil dispute between the petitioner and his relatives i.e.,

the said Cheepurupalli Demudamma & others.

Hence, the 4th respondent suggested the petitioner to approach the concerned Civil Court for redressal. In this connection, entry was made into the General Diary on 07.07.2018 vide entry No.12 and also informed the same to the petitioner by way of notice 24.10.2018.

It is submitted that the contention of the petitioner that the respondent No.4 Station House Officer, Sabbavaram Police Station, Visakhapatnam District, did not receive the complaint of the petitioner sent through registered post is incorrect and baseless. It is submitted that the 4th respondent enquired into the complaint of the petitioner and revealed that the land of the petitioner is under civil dispute, as such no FIR was registered and the same had been informed to the petitioner.

It is submitted that the petitioner instead of approaching the concerned Civil Court against the culprits, filed the present Writ Petition with baseless allegations."

Having regard to the contents of the above instructions, the Writ Petition stands disposed of, keeping it open for the petitioner herein to avail the remedies, in accordance with law.
