Petitioners in this Writ Petition contend that respondents 1 to 3 are trying to lay a High Tension (HT) Electricity Line through their lands situated in R.S.Nos.1001/4, 1001/2B, 982/3, 970/1, 971/2 and 971/3B of Devarapalli Village, Devarapalli Mandal, W.G. District without initiating any proceedings and that in this exercise they are also damaging crops which are existing in the subject lands. Counter-affidavit was filed by the 2nd respondent denying these allegations of the petitioners and contending that the High Tension (HT) Electricity Line is being laid through different survey numbers and not through the above survey numbers, in which the petitioners have their land. In view of the averments in the counter-affidavit, the cause in the Writ Petition no longer survives for adjudication. Therefore, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
