THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40194 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the proceedings in Crime No.848 of 2016, dated 07.11.2016, for offences under Sections 448, 506, 504 IPC, as illegal and arbitrary.

The case of the petitioners is that the de facto complainant lodged the present complaint against the petitioners alleging that on 07.11.2016 at about 12.00 a.m., the petitioners trespassed into the de facto complainant's portion and abused in filthy language and threatened her with dire consequences. The main grievance of the petitioners is that the petitioners are apprehending threat of arrest. Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.848 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners.
