ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.647 of 2025 before the Adilabad II Town
Police Station, Adilabad District, registered for the offences punishable under Section 420, 464, 468, 471 and 467 read with 34 of IPC.

The brief facts of the case are that on 17.11.2025, the de facto complainant lodged a report alleging that he had paid Rs.4,50,000/- through intermediaries for securing outsourcing teaching jobs for his daughters and sister-in-law through Care Foundation, Hyderabad. It was alleged that appointment orders were issued, that the candidates worked for three months without salary, and that the amount was not refunded despite assurances. It was further alleged that a cheque issued for Rs.2,00,000/- by one Edla Chandraiah was dishonoured, leading to the registration of the case against the said persons.

Heard Sri Rapolu Bhaskar, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner's name did not figure either in the FIR or in the complaint and that she was falsely implicated without any specific allegation or overt act and that none of the ingredients of Sections 420, 464, 467, 468 or 471 IPC were attracted against the petitioner, as no dishonest inducement, forgery or use of forged documents was attributed to her. He further submitted that the petitioner was a law-abiding citizen running an NGO, had no criminal antecedents, and that the complaint was lodged with abnormal delay. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition. 6.
In the light of the submissions made by the learned counsel on either side and upon a perusal of the material
available on record, it is evident that the petitioner is not named in the FIR or in the original complaint and there is no specific allegation or overt act attributed to her so as to attract the offences alleged. The dispute appears to be predominantly transactional in nature, the role of the petitioner is not clearly spelt out, and custodial interrogation does not appear to be necessary at this stage. Considering facts and circumstances of the case, this Court deems it appropriate to grant pre-arrest bail to the petitioners, subject to the following conditions: i.
The petitioner shall surrender before the Station House Officer, Adilabad II Town Police Station, Adilabad, within two weeks from today, and on such surrender, the said Station House Officer shall release her on bail on executing a personal bond for Rs.25,000/-, each, with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha
Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
