ORDER:
Petitioner states that he is the owner of an extent of Ac.0.06 guntas of
land in Sy.No.1401/A situated at Tulasinagar, Ward No.27, Jagtial Town, Karimnagar District. Alleging that the second respondent is laying a CC road through part of his land without initiating the land acquisition proceedings, the petitioner filed the present writ petition.
2. The Commissioner/second respondent has filed a counter affidavit specifically stating that road work was called for vide tender notice dated 19.09.2014 for laying CC road in Sy.No.1399 and the work is already completed in the first week of June 2015. It is also stated that the second respondent has never encroached or laid road in Sy.No.1401/A and the road is laid only in Sy.No.1399 as per the revenue record and the municipality is not laying any new road. It is also stated that in future if the municipality wants to lay any road and if that affects the petitioner's land, the second respondent will initiate appropriate proceedings, but, as on today, there is no proposal to lay any new road.
3. In view of the said categorical statements, it is apparent that the petitioner's land is no way affected and as such, no further directions are called for.
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. ______________________ VILAS V. AFZULPURKAR, J July 1, 2015 DSK
