Moturi Anjaiah, Nizamabad And 3 Others v. K Santosh, Nizamabad Dist And 5 Others

THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU I .A.NOs.4 TO 6 OF 2 0 1 8 I N/ AND CI VI L REVI SI ON PETI TON NO. 1 0 0 7 OF 2 0 1 4 ORDER:- I.A.No.4 of 2018 is filed to permit the petitioner to appear and represent on behalf of the other petitioners. I.A.No.6 of 2018 is also filed to permit the petitioner to appear and represent on behalf of the other petitioners. I.A.No.5 of 2018 is filed to record the compromise. I.A.Nos.4 and 6 of 2018 are allowed.

G.P.A.Holders (petitioners in I.A.Nos.4 and 6 of 2018) are present in person. They have been identified by their respective counsel and the Photostat copies of PAN Cards duly signed by the counsel are also filed. On an enquiry, both G.P.A. Holders admit to the following terms of compromise.

"1 . The said lands which are now being compromised are already acquired by the Government and compensation was paid to petitioners while CRP was pending. In terms of the compromise now being recorded i.e., petitioners will become entitled to claim compensation for land in Sy.No.233 to an extent of Ac.1.02 1⁄2 cents, in Sy.No.259 to an extent of Ac.0.18 guntas only situated at Khanapur Shivar of Nizamabad Mandal and respondents will become entitled to claim compensation in

respect of land in Sy.No.234 to an extent of Ac.0.21 guntas from the Government as per law. 2 . Petitioners are paying Rs.15,00,000/ - (Rupees fifteen lakhs only) to the respondents towards the full and final settlement of all their claims in respect of the P.T rights over Sy.Nos.233 and 259. The respondents will have no further claim at any point of time over the above said lands. A separate receipt is executed for payment."

Accordingly, I.A.No.5 of 2018 is allowed and the compromise is recorded. Consequently, the Civil Revision Petition is dismissed in terms of the compromise. No costs. Miscellaneous Petitions pending, if any, shall stand closed in consequence.
