HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.10755 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.

This Writ Petition is filed seeking to declare the action of the 2nd respondent in suspending the authorization of the petitioner vide proceedings dated 26.02.2015, as illegal and arbitrary.

Petitioner is the dealer of fair price shop No.21, Kothapeta Village, Gooty Mandal, Anantapuramu District. On 02.02.2015, the 3rd respondent-Tahsildar, Gooty, inspected the fair price shop of the petitioner, verified the stock and found certain variations. Based on the report submitted by the 3rd respondent, the 2nd respondent issued show cause notice dated 13.2.2015, for which, the petitioner submitted his explanation. Thereafter, the 2nd respondent vide proceedings dated 26.2.2015 suspended the authorization of the petitioner. Learned counsel appearing for the petitioner submits that the respondent authorities ought to have given 15 days time to the petitioner to submit his explanation, but without granting sufficient time,

suspended the authorization of the petitioner. Since the impugned order is only an order of suspension, the 2nd respondent-Revenue Divisional Officer is directed to conduct enquiry and pass final order within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
