HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37191 OF 2018 ORDER:

The present writ petition came to be filed aggrieved by the order dated 12.9.2018, passed by the 3rd respondent in proceedings RC No.B1/592/2018.

The grievance of the petitioner appears to be that the impugned order came to be passed without issuing any notice to the petitioner. But a perusal of the impugned order shows that the petitioner has got remedy of filing the appeal against the impugned order before the Joint Collector.

Having regard to the facts and circumstances of the case and without going into merits of the case, the writ petition is disposed of giving liberty to the petitioner to avail the remedy available under law by filing an appeal before the Joint Collector against the impugned order, in which case, the Joint Collector shall deal with the same and pass appropriate orders, in accordance with law, as early as possible within a period of three to five months from the date of filing of the appeal. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
