THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.26229 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India questioning the action of the respondents in registering the F.I.R.No.202 of 2014 for the alleged offences under Sections 3 and 4 of A.P. Gaming Act and Section 8 r/w.13 of A.P. Places Public Resort Act, 1988.

A counter-affidavit is filed by the Sub-Inspector of Police, I Town Police Station, Eluru, West Godavari District, wherein it is stated that on 31-01-2015 the Investigating Officer filed charge sheet along with Form-60 and the case is pending trial vide C.C.No.242 of 2015 on the file of the Court of II Addl. Judicial Magistrate of First Class, Eluru and the said case stands posted to 10-09-2015.

In view of the above averments in the counter-affidavit, the question of quashing the F.I.R. at this stage does not arise. Accordingly, the writ petition is dismissed.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
