HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18054 of 2016 ORDER:

Heard learned counsel for the petitioner, Government Pleader for Municipal Administration and learned Standing Counsel for Jagtial Municipal Council, Karimnagar District. With the consent of all the parties, the main writ petition is taken up for disposal at the admission stage itself.

The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the 2nd respondent in not inspecting or conducting enquiry of the construction made by the petitioner over the land covered by H.No.5-3-252, Shiva Veedhi, Gunj road, Jagtial by revoking or withdrawing the provisional notice in File No.UCR.No.19/TP/201516 dated 07.05.2016, as illegal and arbitrary. The learned counsel for the petitioner mainly submits that pursuant to a provisional notice issued on 07.05.2016 vide proceedings No.UCR.No.19/TP/2015-16, the petitioner has submitted an explanation on 09.05.2016, which was acknowledged by the Municipality. It is said that till date no order has been passed, which is putting the petitioner to lot of inconvenience.

The learned Standing counsel appearing for the second respondent/Municipality submits that the explanation given by the petitioner will be considered in accordance with law at the earliest.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the second respondent to pass appropriate orders on the explanation submitted by the petitioner pursuant to a provisional notice issued on 07.05.2016 vide proceedings No.UCR.No.19/TP/2015-16, as early as possible preferably within a period of four weeks from the date of receipt of copy of the order. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
