THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37016 OF 2018 ORDER :

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material on record.

When the matter is taken up, written instructions, dated 11.10.2018, furnished by the Sub Inspector of Police Uppal Police Station, Rachakonda Commissionerate, are placed on record by the learned Government Pleader.

The said instructions, to the extent of their relevance to the present Writ Petition, read as under:

"The facts of the case are that the 4th respondent T.Chiranjeevi lodged a complaint on 29.09.2018 with the 3rd respondent Station House Officer, Uppal Police Station, Rachakonda Commissionerate, wherein he stated that the petitioner is his friend. The petitioner stated that he got loss in real estate business and requested to give Rs.50.lakhs as hand loan.

Accordingly the 4th respondent arranged an amount of Rs.30.lakhs from one G.Shakuntala and paid to the petitioner herein on different dates. On repeated request the petitioner repaid Rs.5,50,000/- only and threatened that not to ask remaining amount. Basing on the complaint of the 4th respondent, a case was registered in Cr.No.916/2018

AVSS,J W.P.No.37016 of 2018 dated 29.09.2018 for the offences u/s 420, 506 IPC against the petitioner herein and investigation is under progress.

It is submitted that, except registering the FIR No.916/2018, the 3rd respondent did not interfere with the life and liberty of the petitioner at any point of time.

It is submitted that the respondents never obtained the alleged signatures of the petitioner on 11.09.2018 or any other date as contended by him.

It is submitted that the contention of the petitioner that the respondent No.4 under the guidance of the 5th respondent forcefully taken the petitioner to the office of the 5th respondent and on the point of gun taken signatures on some papers on 11.09.2018 is incorrect and baseless.

It is incorrect to say that with the help of respondent No.3, the respondent No.4 tried to clear the misappropriate amounts in his office with regard to repayment of loan of Rs.30 lakhs and other amounts, hence denied.

It is submitted that the respondents discharging their legitimate duties, but they never interfered with the life and liberty of the petitioner or his family members and never obtained the signatures of the petitioner as alleged by him.

The present Writ Petition has been filed by the petitioner accused to escape from the criminal liabilities of the criminal cases".
