Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue.
Each of the petitioner claims that they are in possession of the land admeasuring Ac.0-04 gts., in Sy.No.351 situated at Badarupally Village and Gram Panchayat, Mulug Mandal, Warangal District. They seem to have constructed houses with the permission of the Gram Panchayat and living their since 2012 and paid municipal tax to the Gram Panchayat and House numbers are also stated to have been assigned to them. They have submitted applications on 03-012015 for regularisation under G.O.Ms.No.59, dated 30-12-2014. However, it is alleged that without any prior notice or enquiry, the 4th respondent and his subordinates visited the site and demolished compound wall around the house. The present writ petition is filed apprehending demolition without notice.
Learned Government Pleader states that the applications if any filed by the petitioners, are pending for regularisation will be considered on its own merits.
Hence, it is appropriate to direct respondents 2 to 4 to consider the petitioner's aforesaid applications in terms of the aforesaid G.O. and pass appropriate orders. In the meanwhile, if any action is intended to be taken against the petitioners by the 4th respondent or his subordinates, an opportunity to file explanation shall be given to the petitioners and thereafter, the 4th respondent shall pass necessary orders and then proceed further in the matter as per law. The writ petitions are accordingly disposed of. No costs Miscellaneous petitions, if any, pending in the writ petitions shall stand closed.
