THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.19591 of 2015 ORDER:

This Writ Petition is filed challenging the proceedings of the 2nd respondent, dated 13.03.2015, ordering enquiry under Section 51 of the Andhra Pradesh Cooperative Societies Act, 1961, into the affairs of the G.Kothapalli Primary Agricultural Cooperative Society Limited. The petitioner is a President of the said Society. Though no counter affidavit is filed, learned Government Pleader for Cooperation, on the basis of written instructions, submits that the enquiry officer commenced enquiry on 19.03.2015 and the same is almost completed.

In view of the power vested with the 2nd respondent to order enquiry, this Court is not inclined to interfere with the enquiry process at this stage. However, it is open to the petitioner to challenge the proceedings pursuant to the enquiry, if he is aggrieved, in appropriate proceedings.

With the above observations, the Writ Petition is closed. There shall be no order as to costs.

The miscellaneous petitions pending, if any, shall stand closed.
