THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.2866 of 2016 ORDER:

The petitioner, who is accused No.1 in C.C.No.507 of 2015 on the file of the XX Metropolitan Magistrate, Ranga Reddy District at Malkajgiri, filed the present Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of charge-sheet in C.C.No.507 of 2015.

A perusal of the record shows that initially a case in Crime No.421 of 2009 came to be registered for the offence punishable under Section 420 I.P.C. The Police, after investigation, filed a charge-sheet, which was taken on file as C.C.No.902 of 2009 on the file of the X Metropolitan Magistrate, Cyberabad at Malkajgiri, subsequently, it was transferred to the Court of XX Metropolitan Magistrate, Ranga Reddy District at Malkajgiri, wherein it was re-numbered as C.C.No.507 of 2015.

After arguing for sometime, the learned counsel for the petitioner, confined his arguments to the extent of dispensing with the presence of the petitioner before the trial Court. Considering the facts and circumstances of the case and in view of the submissions made by the learned counsel for the petitioner, the presence of the petitioner before the trial Court in C.C.No.507 of 2015 on the file of the XX Metropolitan Magistrate, Ranga Reddy District, is dispensed with except on the dates when his presence is required by the Court.

The Criminal Petition is, accordingly, disposed of.

Miscellaneous petitions pending in this criminal petition, if any, shall stand closed.
