HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37127 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent-Joint Collector, in not disposing of the Revision Petition No.11 of 2018, filed by the petitioner against the order dated 11.12.2017, passed by the 3rd respondent-R.D.O in R.C.D.Dis.No.10876 of 2016, as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioner submits that though the petitioner filed Revision Petition No.11 of 2018, before the 2nd respondent-Joint Collector along with the stay petition in the month of February, 2018, questioning the order dated 11.12.2017, passed by the 3rd respondent-R.D.O, till date no orders are passed and hence he prays to allow the writ petition. Learned Government Pleader for Revenue, would submit that the 2nd respondent-Joint Collector, may be directed to dispose of the above said revision filed by the petitioner, in accordance with law, within a reasonable time.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent-Joint Collector, to dispose of the Revision Petition No.11 of 2018, filed by the petitioner against the order dated 11.12.2017, passed by the 3rd respondent-R.D.O in R.C.D.Dis.No.10876 of 2016, in accordance with law, as early as possible, preferably within a period of two to four months from the date of receipt of copy of this order. If any stay petition is filed along with the said revision, the 2nd respondent-Joint Collector, shall verify and pass appropriate orders on the stay application within a period of two to three weeks from the date of receipt of copy of this order, after giving reasonable opportunity of hearing to the petitioner and all concerned.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
