THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.4767 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/accused in C.C.No.426 of 2014 on the file of the Court of the Special Magistrate, Nandyal.

Heard the learned counsel for both the parties. The learned counsel for the petitioner submitted that the trial Court issued the Non-Bailable Warrant against the petitioner on 30.03.2015. Hence, he seeks permission of this Court to permit the petitioner to withdraw the criminal petition with liberty to file a petition under Section 70 (2) Cr.P.C. before the trial Court to recall the Non-Bailable Warrant issued against him.

Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn granting liberty as prayed for. If the petitioner files a petition under Section 70 (2) Cr.P.C., the trial Court is hereby directed to dispose of the same on the same day in accordance with law. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
