THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21557 OF 2016 ORDER:

Heard the learned counsel for the petitioners, learned Government Pleader for Revenue for Municipal Administration and Urban Development, for respondent No.1 and Sri S.D. Goud, learned Counsel for respondent No.2. With consent of the counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.

Since this Court is not going into merits of the case, hearing the unofficial respondent may not be necessary. 2 . The present writ petition came to be filed with the following prayer:

"to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondent No.2 in considering the representation, dated 15-06-2016 submitted by the petitioners and taking further action from preventing illegal constructions being made by the respondent No.3 for setting up of a Poultry Farm in the midst of residential locality that too without any permission whatsoever as arbitrary, illegal, abdication of statutory duty cast on him and violative of fundamental rights guaranteed to the petitioners under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.2 to act on the representation, dated 15-06-2016 submitted by the petitioners and take appropriate action forthwith to prevent the illegal constructions being raised by the respondent No.3 and setting up of Poultry Farm therein and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

Though various grounds are raised in the writ petition, learned counsel for the petitioners mainly submits that representation dated 15.06.2016 made by the petitioners marking a copy to the 2nd respondent with regard to illegal constructions made by the 3rd respondent for setting up of a Poultry Farm in the midst of residential locality without any permission, which are causing lot of inconvenience to the residents and children, is not considered till date.

Having regard to the same, the Writ Petition is disposed of directing the 2nd respondent to consider the representations dated 15.06.2016 made by the petitioners and also by the Narayana Junior College, Kadapa, and pass appropriate orders thereon, in accordance with law, as early as possible preferably within a period of ten (10) days from the date of receipt of a copy of this order, after hearing the petitioners and aggrieved persons, if any. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
