THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37051 2018 ORDER :
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material on record.
When the matter is taken up, written instructions, dated 220.2018, furnished by the Sub Inspector of Police, Gadwal Town Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:
"petitioner herein has filed a private complaint lilsee.200 Cr.P.C., before the Hon'ble Court of Judicial Magistrate of first Class at Gadwal against the official respondent Mr.T.Srinivas, Sub inspector of Police, Gadwal Town Police Station/5th respondent herein. Upon receipt of the said complains, the Hon'ble Court forwarded it to the Station House Officer, Gadwal Town Polic Station for enquiry and report U/sec.156 (3) Cr.P.C.
On receipt of the said private complaint from the Hon'ble Court, a case in Cr.No.96/2018 U/sees.120 (B), I 66, 177, 195, 196, 209, 211, 193 r/w 191, 192, r/w. 194 IPC and Sec.156 (3) Cr.P.0 dated 7.4.2018 was registered on the file of Gadwal Town Police Station, Jogulamba -Gadwal District against the respondent Mr.T.Sreenivas and taken up the investigation into the case.
It is further respectfully submitted that the petitioner herein has filed a private complaint U/sec.200 Cr.P.C before the Hon'ble Court of Judicial Magistrate of First Class at Gadwal against the unofficial respondent Md.Amjad Ali, Sub Inspector of Police, Gadwal Town Police Station/6th respondent herein.
Upon receipt of the said complaint, the Hon'ble Court forwarded it to the Station House Officer, Gadwal Town Police Station For enquiry and report U/sec. I 56 (3) Cr.P.C.
On receipt of the said private complaint from the Hon'ble Court, a case in Cr.No.97/2018 U/secs.120 (B), 166, 177, 195, 209, 211, 193 r/w 191, 192, r/w 194 IPC and Sec.156 (3) Cr.P.C.dated 17.4.2018, was registered on the file of the Gadwal Town Police Station, Jogtilamba-Gadwal District against the 6th respondent Md.Amjad All and taken up the investigation into the case.
It is respectfully submitted that in both the cases, the investigation officer, Circle Inspector of Police, Gadwal Circle has examined as many as five witnesses including the complainant/petitioner and recorded their detailed statements.
It is respectfully submitted that the investigation is under progress and it is pending for want of examination of some more witnesses and to collect material evidence to establish the offences against the alleged accused/5th and 6th respondents herein. It is humbly submitted that to complete the fullfledged investigation in both the crimes, it requires minimum 2 months to the investigating agency for completion and for filing appropriate reports U/sec 173 Cr.P.C., before the concerned I-Ion'ble Court. It is humbly submitted that due to administrative grounds, some delay has caused in completing the investigation into the above 2 crimes and the same is neither wilful nor wanton.
I humbly submit that I assure to this Hon'ble Court that the investigation in the above 2 crimes will be completed within a period of 2 months".
By placing on record the above written instructions, Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ A.V.SESHA SAI, J 25th October, 2018 Tsy
