HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37188 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not disposing of the appeal No.D2/2125/2018 filed by the petitioner on the file of R.D.O, Suryapet along with interlocutory applications seeking stay of all further proceedings in D/2310/2006 on the file of Tahsildar, Thirumalagiri as illegal and arbitrary.

Learned counsel for the petitioner submits that though the petitioner submitted an appeal along with stay petition on 29.9.2018, no action has been taken so far for disposal of the same. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent-R.D.O to deal with the appeal No.D2/2125/2018, filed by the petitioner and pass appropriate orders, in accordance with law as early as possible, preferably within a period of three to six months from the date of receipt of copy of this order by giving the reasonable opportunity of hearing to the petitioner and all concerned. If the authority is of the opinion that the appeal, though entertained, could not be disposed of within the time fixed, he may pass appropriate orders in the stay application if filed along with the appeal within a period of four to six weeks in accordance with law. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
