THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1770 OF 2016 ORDER:

The petitioners/A.4 and A.5 have preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the docket Order dated 18.04.2016 passed in C.C.No.698 of 2014 by the Court of the Special Judicial First Class Magistrate for Prohibition and Excise, Guntur, whereby the learned Judge adjourned the matter to 20.06.2016 and directed that if the petitioners fail to appear before the said Court on the said date, Non Bailable Warrants (NBWs) would be issued.

Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioners are in no way concerned with the alleged offence under Section 498-A IPC and that the Court below ought to have dispensed with the presence of the petitioners herein. Considering the nature of allegations and also as the question of identity of the petitioners/A.4 and A.5 does not arise, the presence of the petitioners/A.4 and A.5 before the Court below is dispensed with. The petitioners are also directed to answer the questions under Section 313 CrPC., through their counsel and they are directed to appear before the Court below on the date of pronouncement of Judgment.

The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 11.07.2016 pln
