THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO WRIT PETITION NO.30947 OF 2012 ORDER:

This Writ Petition was filed challenging the action of the second respondent in permitting the unauthorized construction in the premises bearing H.No.6-1-230 beside Ashoka Hotel, Hanamkonda, Warangal District, pursuant to proceedings 31.03.2010, in spite of pendency of representations of the petitioner dated 03.07.2012 and 09.07.2012. It appears that, challenging the said permission, the petitioner filed WP.No.7103 of 2012 and the same was disposed of on 08.11.2016. Since the constructions were proceeding on the basis of a valid permission granted, the petitioner ought to have challenged the permission in an appropriate forum but he cannot challenge the action of the second respondent in permitting the constructions so long as the permission is in operation.

In the circumstances, the Writ Petition has become infructuous and is, accordingly, dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed. ________________________ (A.RAMALI NGESWARA RAO, J) 22nd November 2016 RRB
