HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34349 of 2016 ORDER:
Heard Mr.T.Ramulu, learned counsel for petitioner and Mr.V.Satyam Reddy, learned Standing Counsel for respondent No.2. The grievance of petitioner is against the threatened action of respondent No.2 in acquiring petitioner's property bearing Nos.8-1-225 to 828 and 8-1-218 and 219 forming part of Survey No.366/A, situated at Kottarampur, Karimnagar and demolishing 8 feet of the said property for road widening without due process of law or paying compensation under Act 30 of 2013. On instructions, learned Standing Counsel makes a statement that firstly, respondent No.2 tries to voluntarily obtain consent of the petitioner; secondly, respondent No.2 will consider and dispose of the representation received on 01.10.2016 and proceed in accordance with law. The statement is placed on record.
Writ petition is disposed of by directing respondent No.2 to pass orders on the representation received on 01.10.2016, within three weeks from today. It is needless to observe that unless the exercise as directed by this Court is completed, respondent No.2 shall not demolish any portion of subject premises. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
