HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37350 of 2018 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the writ petition is heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not issuing orders for making entry of their names in the Resettlement Register and other revenue records, in respect of land admeasuring Ac.0.19 cents and 0.05 respectively in Survey No. 254/ 2 of Kothapalli Panchayat, Modamidipalli Village, Proddatur Mandal, YSR Kadapa district and deleting the same from the prohibited properties list furnished to the 4th respondent under Section 22-A(1) of the Registration Act, 1908, as illegal, arbitrary and unconstitutional.

3) Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to consider the applications made by the petitioners on 20.06.2018 and 03.06.2018 respectively, seeking updation of their names in the Re-settlement Register and deletion of their properties from the prohibited list of properties. 4) The Government Pleader for Revenue submits that if the applications made by the petitioners are still pending, the same will be considered in accordance with law.

5) Having regard to the above, the writ petition is disposed of at the admission stage, directing the authorities concerned to examine the applications made by the petitioners on 20.06.2018 and 03.06.2018 respectively, seeking updation of their names in the Re-settlement Register and deletion of their properties from the prohibited list of properties, in respect of land admeasuring Ac.0.19 cents and 0.05 respectively in Survey No. 254/ 2 of Kothapalli Panchayat, Modamidipalli Village, Proddatur Mandal, YSR Kadapa district, and pass orders in accordance with law as early as possible, preferably, within a period of three months from the date of receipt of a copy of the order. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
