HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Notification No.08/2018 was issued by Transmission Corporation of Telangana Limited on 08.08.2018 calling for applications to make selections for recruitment to the post of Junior Personnel Officer. Petitioner responded to the said notification. This writ petition is filed contending that he is not issued Hall Ticket for appearing in the examination scheduled to be held on 14.10.2018.

According to learned counsel for petitioner, petitioner possessed B.Tech. Degree and, therefore, he is eligible to compete on par with other Graduates and, therefore, not issuing Hall Ticket, having accepted his application, is arbitrary and discriminatory.

According to learned senior counsel Sri G.Vidya Sagar appearing for Transmission Corporation of Telangana Limited, on 04.06.2018 amendments were carried out to Service Regulations Part-III. In Annexure-VI against category-2, there is change in the educational qualifications. As per the amendment, a candidate competing for the post of Junior Personal Officer must hold First Class Bachelor Degree in Arts or Commerce or Science from a recognized University or its equivalent qualification and the same is incorporated in the recruitment notification. Apparently, petitioner is not having any of those three Degrees, but he is having Bachelor of Technology. Bachelor of Technology is a professional course and as Degree awarded is a professional

degree, it cannot be said that it is equivalent. When employer specifically prescribes First Class Degree in Bachelor of Arts/ Commerce/Science, merely because petitioner possessed Professional Degree, it cannot be assumed that qualification possessed be treated as equivalent to make him eligible for selection.

Learned senior counsel also pointed out that application of petitioner is rejected on the ground that he does not have requisite qualification, and the amendments carried out to the Service Regulations are not under challenge. Therefore, the decision of respondent-Corporation in not issuing Hall ticket cannot be faulted. Writ Petition is accordingly dismissed. However, it is open to petitioner to work out his grievance, if so advised, against qualifications prescribed in the Service Regulations.
