THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS CONTEMPT CASE No. 2313 OF 2015 O R D E R : (per Hon'ble Sri Justice Nooty Ramamohana Rao) This Contempt Case is initiated by the petitioner, who moved Review W.P.M.P. No. 47660 of 2014 in Writ Petition No. 10680 of 2012. He sought for review of the order passed by this Court in Writ Petition No. 10680 of 2012 on 01.04.2014. That Review Application was considered by us and was dismissed on 09.11.2015. Out of compassion, towards the end of our order, we observed that if the petitioner, only by virtue of pendency of this miscellaneous petition, has not joined duties so far, he should do so at the earliest, at any rate within a period of 15 days from that day. Even after this observation has been made by us, the petitioner has not moved in the matter.

Contrary to our expectations that he would report to the duty at the earliest, he took his own time of entire 15 days for reporting to duty. It appears, he reported to duty on 23.11.2015 at Tiruvananthapuram only to be informed that the competent authority has already passed the order of dismissal from service on 23.11.2015 and the communication in that regard has been left with the petitioner on 26.11.2015 by the Deputy Director General, Geological Survey of India, Tiruvananthapuram.

The present Contempt Case is moved on the premises that the respondents have deliberately violated the direction issued by this Court in the review order passed by us, referred to supra.

A feeling has been left behind in our mind that the petitioner is only interested in litigating and is not interested in attending to the duties and responsibilities diligently. When we observed that the petitioner should report to duty at the earliest, in our order dated 09.11.2015, he, far from complying with that, waited for the 15days outer limit specified by us. Thus, the petitioner has, in fact, acted contrary to the spirit with which we passed the order.

For the above reason, we do not find any justifiable ground to entertain this Contempt Case and it is accordingly dismissed.
