.....Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ or order or direction more particularly one in the nature of Writ of Mandamus declare the action of the 2nd respondent in trying to demolish and interfering with the construction of RCC residential Apartment Building consisting of stilt for Parking + Ground Floor + 4 Upper Floors in Sy.No.296/11, 12, 13, 15, 16 & 17, situated at Kanithi Village, Ward NO.52, Visakhapatnam within the limits of Greater Visakhapatnam Municipal Corporation carried out by the petitioners pursuant to the construction permission issued by the 2nd respondent corporation in B.A.No.12459/2008/ACP-V/G2, dated 31-12-2010, is illegal, arbitrary and violative of Article 300-A of the Constitution of India and apart from being violative of principles of natural justice, and consequently direct the 2nd respondent not to interfere with the construction work carried out by the petitioners.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri Venkata Rangadas Kanuri, Advocate for the Petitioners and Sri S. Laxminarayana Reddy, learned Standing Counsel for Respondent No.2, the Court made the following
