THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.34363 of 2015 ORDER :

The grievance of petitioner in this Writ Petition is that petitioner's application for renewal of license for manufacturing, repairing and dealing with weighing instruments for the year 2015 has been returned without assigning any reason under the impugned Memo No.5069/L2/2013 dt.26.09.2015 issued by Controller, Legal Metrology, Hyderabad.

2. The petitioner contends that the license for these three skills for the year 2014 be deemed to have been approved since he had filed an application on 29.11.2013 itself for renewal.

However, since both 2014 and 2015 calendar years have now elapsed, in the interests of justice, the petitioner is directed to make fresh application to respondents for issuance of license for the above three skills by paying the requisite license fee and enclosing all the relevant material as prescribed by law.

4. The learned Government Pleader for respondents assures that respondents will consider the fresh application of petitioner in accordance with law and communicate their decision thereon to petitioner within a period of three (03) weeks from the date of receipt of a

copy of the said application.

In this view of the matter, the Writ Petition is disposed of directing petitioner to make a fresh application for grant of license for the three skills of manufacturing, repairing and dealing with weighing instruments for the year 2016 within two (02) weeks from today and on receipt of such application, the Controller, Legal Metrology, Hyderabad, will consider the same in accordance with law, and communicate its decision thereon to the petitioner within a period of three (03) weeks thereafter.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.
