HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37341 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the proceedings of the 2nd respondent in Draft Memo No. G2/ 19134/ 2011, dated 01.12.2011, as illegal and unconstitutional and to consequently direct the 4th respondent to receive and register the document that may be presented by the petitioner for registration, in respect of the property admeasuring 286 square yards, Door NO.8/ 109 in Survey No. 238, situated at 8th Ward, Pullaripet, Podili village and Mandal, Markapuram Revenue Division, Prakasam district, without reference to the memo of the 2nd respondent bearing No. G2/ 19134/ 2011, dated 01.12.2011.

2) Learned counsel for the petitioner, as well as learned Government Pleader for Revenue would submit that the issue involved in this writ petition is covered by orders of this Court in W.P.No. 24316 of 2013 and batch, dated 05.09.2013 as well as in W.P.No. 4595 of 2015 and batch dated 04.03.2015. 3) Following the same, this writ petition is allowed, setting aside the refusal order dated 01.12.1011, and directing the Sub Registrar, Podili to receive and process the documents presented by the petitioner in respect of the subject land, without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No. 1205 of 2010. In the event the documents

presented are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Sub Registrar, Podili shall complete the registration formalities and release the documents in accordance with the due procedure. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
