HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.16668 of 2016 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to relax the conditions imposed against the petitioners/ A.1 to A.6 by the Metropolitan Sessions Judge cum I Additional District & Sessions Judge at Visakhapatnam in Crl.M.P.No.3897 of 2016, dated 24.11.2016 as " petitioners/ A1 to A5 shall furnish a personal bond of Rs.50,000/ - each and petitioner/ A6 shall furnish a personal bond of Rs.1,00,000/ - respectively and two sureties who shall furnish fixed deposits of Rs.50,000/ - and Rs.1,00,000/ - respectively each to the satisfaction of the II-Additional Chief Metropolitan Magistrate, Visakhapatnam."

Learned counsel for the petitioners submits that the petitioners are economically poor persons and are not in a position to comply with the conditions imposed against them due to lack of poverty. Therefore, they pray to relax the above conditions.

Learned Additional Public Prosecutor opposed the said petition. Keeping in view the fact that the petitioners are economically poor persons, I am inclined to modify the conditions imposed by the Metropolitan Sessions Judge, Visakhapatnam in Crl.M.P.No.3897 of 2016 to the effect that the petitioners/ A1 to A5 shall furnish a personal bond for Rs.50,000/ - and A6 shall furnish a personal bond of Rs.1,00,000/ -, with two sureties for the like each to the satisfaction of the II-Additional Chief Metropolitan Magistrate, Visakhapatnam.
