THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 4393 of 2015 Order:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed against the orders, dated 10.01.2015, passed in Crl.M.P. No.104 of 2014 in FCOP No.14 of 2014 by the VI Additional District Judge, Ongole, whereby and whereunder the learned Judge granted interim maintenance of Rs.10,000/- per month to the second respondent herein.

The contention of the learned counsel for the petitioner-husband is that the petitioner is not earning a sum of Rs.68,500/- per month as alleged, but he is drawing a salary of Rs.34,500/- per month and he has to maintain his aged parents. Having regard to the facts and circumstances of the case, pending adjudication of FCOP No.14 of 2014, I feel that the ends of justice would be met if the petitioner is directed to pay interim maintenance of Rs.7,000/- per month instead of Rs.10,000/- per month as ordered by the Court below. Accordingly, the Criminal Petition is disposed of directing the petitionerhusband to pay interim maintenance of Rs.7,000/- per month to the second respondent-wife herein.

As a sequel thereto, the miscellaneous petitions, if any, pending in the Criminal Petition shall stand closed.
