HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.12018 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4. This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide proceedings dated 4.4.2015, as illegal and arbitrary.

Petitioner is the dealer of fair price shop No.27, Model Colony, Hindupur Mandal, Anantapur District. On 23.3.2015, the vigilance authorities inspected the fair price shop of the petitioner and found certain variations. Thereafter, the authorization of the petitioner was suspended. Learned counsel appearing for the petitioner submits that the irregularity pointed out is not a serious one and therefore, the order of suspension is not warranted.

In any event, this Court is of the view that it would be appropriate to direct the 3rd respondent-Revenue Divisional Officer, Penukonda, to conduct enquiry and pass order within a stipulated period. Consequently, the Writ Petition is disposed of directing the 3rd respondent to conduct enquiry and pass appropriate order in accordance with law, within a period of eight weeks, after affording an opportunity of personal hearing to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
