HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.790 of 2014 ORDER:

This petition is filed to withdraw H.M.O.P.No.45 of 2013 from the file of Senior Civil Judge, Kavali, Nellore District and transfer the same to Senior Civil Judge, Addanki, Prakasam District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of transfer petition, according to which, her marriage with respondent was performed on 29.08.2010 and she was necked out from the marital home and thereafter she filed M.C.No.21 of 2013 before Additional Judicial First Class Magistrate, Addanki and also filed DVC No.11 of 2013 before Judicial First Class Magistrate, Addanki and both cases are pending. She stated that to create hurdles and as a counter blast, respondent filed H.M.O.P. No.45 of 2013 before Senior Civil Judge, Kavali, Nellore and distance between Addanki and Kavali is approximately 150 KMs. She further stated that she cannot travel independently and she also apprehends insecurity to attend the Court at Kavali alone. She further stated that respondent is attending Addanki in connection of two cases filed by her and no prejudice will be caused to him, if this H.M.O.P No.45 of 2013 is transferred from Senior Civil Judge, Kavali to Senior Civil Judge, Addanki.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit and also considering the fact that respondent is already attending Courts at Addanki in connection of Maintenance Case and DVC, H.M.O.P.No.45 of 2013 is withdrawn from the file of Senior Civil Judge, Kavali, Nellore District and transferred to Senior Civil Judge, Addanki, Prakasam District for disposal in accordance with law.

6. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
