THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P.No.6740 of 2016 & CRIMINAL PETITION No.13917 of 2015 ORDER:

This Criminal Petition is filed by A.1 to A.4 under Section 482 of Criminal Procedure Code seeking to quash the proceedings in C.C.No.1024 of 2014 pending on the file of II Additional Judicial Magistrate of First Class, Bhimavaram, West Godavari District for the offences under Sections 138 and 142 of Negotiable Instruments Act.

When the matter is taken up for hearing, both the counsel filed Crl.P.M.P.No.6740 of 2016 stating that the parties have entered into compromise and therefore, they prayed to quash the impugned proceedings in the C.C.

Both the parties as well as their counsel have signed on the memorandum of compromise annexed to Crl.P.M.P.No.6740 of 2016. The parties, who are present in the Court, also affirmed the same. A perusal of the affidavit filed in support of the petition goes to show that the matter was settled between the parties.

In view of the amicable settlement of the dispute between the parties and in view of the nature of the proceedings, Crl.P.M.P.No.6740 of 2016 is ordered and the compromise is recorded. Consequent thereto, the Criminal Petition is allowed and the proceedings in C.C.No.1024 of 2014 pending on the file of II Additional Judicial Magistrate of First Class, Bhimavaram, West Godavari District are hereby quashed as against the petitioners herein. Miscellaneous petitions, if any, filed in this petition shall stand closed. _________________ RAJA ELANGO,J
