THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31888 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Forests for respondents.

2. The petitioner claims to be the owner of vehicle bearing No.AP01Q 5902. On 17.08.2015, the third respondent seized the said vehicle on the ground that the vehicle was ploughing the reserve forest land in Madaram Reserve Forest in Compartment No.318. A case in POR No.958/39 dated 17.08.2015 was registered against the petitioner. The seized tractor was produced before the second respondent under Section 44 of the A.P. Forest Act. The case record was sent to the Judicial Magistrate of First Class at Bellampally.

3. In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to file an appropriate application before the Judicial Magistrate of First Class at Bellampally for release of the vehicle. If the third respondent has not produced the vehicle before the said Court, he shall do it so within a period of three days from the date of receipt of a copy of this order in order to enable the petitioner to take appropriate steps for release of the vehicle.
