HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO Writ Petition No.9806 of 2015 ORDER:

The petitioner has claimed to have retired from service of the State Government as a Mandal Surveyor, having held the said post in the office of the Tahsildar, Ghatekeswar. He also seeks certain terminal benefits to be paid to him, which according to the petitioner, have been withheld unjustly by the respondentState.

2. Payment of pension, payment of death cum retirement gratuity (DCRG), payment of encashment of earned leave and payment of commuted value of a portion of the pension, are all matters relating to the conditions of services of the Government servants. Any dispute concerning them will have got to be adjudicated at the first instance by approaching the Andhra Pradesh Administrative Tribunal, created under the Administrative Tribunal Act, 1985 as per the principles settled by the Supreme Court in 'L. Chadrakumar vs. Union of India' [(1997)3 SCC 261].

3. Accordingly, reserving liberty to the petitioner to approach the Andhra Pradesh Administrative Tribunal at the first instance and then only approach this Court, in case of any necessity, the present writ petition is dismissed at the admission stage. No costs. Pending miscellaneous petitions, if any, in this writ petition shall stand closed.
