Heard Mr.V.H.V.R.R.Swmay for petitioners and the Government Pleader for Civil Supplies.

The petitioners pray for Mandamus declaring the action of 3rd respondent in seizing stock of 166.35 quintals of rice and also lorry bearing No. AP 37 Y 1326 on 19.09.2016, as illegal and without jurisdiction.

Mr.Swamy for petitioners confines his submissions to direct the 2nd respondent to consider the request of petitioners to release vehicle No. AP 37 Y 1326 as and when representation is made in this behalf. He further submits that the petitioners are prepared to furnish bank guarantee for half of the value shown in the Panchanama for vehicle bearing No. AP 37 Y 1326 . Learned Government Pleader opposes that the vehicle cannot be released by receiving half of the value shown in the Panchanama.

The petitioners are given liberty to file representation to 2nd respondent for release of vehicle bearing No AP 37 Y 1326 within one week from today and the 2nd respondent is directed to determine half of the value shown in Panchanama for the subject vehicle, call upon the petitioners to furnish bank guarantee and also impose further condition that the vehicle shall not be alienated or the petitioners undertake to produce the vehicle as and when directed by the authorities. The petitioners after complying with the

conditions imposed by the 2nd respondent can be given interim custody of the vehicle. The entire exercise shall be completed within four weeks from today.
