HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 34 OF 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This appeal by the appellant - institute is directed against one line order, dated 31.12.2015, passed in W.P.M.P.No.49687 of 2015 in W.P.No.38599 of 2015, which reads thus:
"There shall be interim direction as prayed for." In the writ petition, respondent No.1 has made the following prayer:
"For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus directing the respondents to allow the petitioner in the forthcoming II-Semester, B.Tech, Metallurgy and Materials Engineering, IV year, in Mahatma Gandhi Institute of Technology, Chaitanya Bharathi P.O. Gandipet, Hyderabad, Telangana State by granting exemption of attendance to the petitioner and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." We are informed that the appellant - institution has already filed counter affidavit and placed all materials in support of their case and that the writ petition is ready for hearing.
Keeping that in view and considering the nature of the impugned order and the prayer in the writ petition, we are not inclined to interfere with the same and we are satisfied that the following order will meet the ends of justice:
"Learned Single Judge, who is assigned to hear the writ petitions, is requested to hear and decide the instant writ petition expeditiously in view of the fact that an academic career of the writ petitioner is at stake. It is made clear that we have not examined merits of the case."
