Chintakayala Venkateswarlu Alias Yogi Vemanna v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No. 2643 of 2015 DATE: 20.02.2015 Between:
Chintakayala Venkateswarulu and 20 others .. Petitioners And
1. The State of A.P.
2. The District Collector
3. The Revenue Divisional Officer
4. The Mandal Revenue Officer .. Respondents
O R D E R:- The sum and substance of the petitioners' case is that they were granted D-Form pattas over small extents of lands in Sy.No.1228/A situated in Velugodu village and Mandal, Kurnool District and they raised temporary structures and have been residing therein for a long time. The petitioners' main grievance is that the respondents, without issuing any notice and without following the due process of law, are threatening to dispossess them from their lands by removing the existing structures forcibly.
Hence, the present writ petition is filed seeking appropriate directions. On 10.02.2015, when the matter was taken up for admission, the learned Government Pleader for Revenue sought time to get instructions, as such, the matter was adjourned to 16.02.2015, on which date, further time was sought. Even today, when the matter is called, the learned Government Pleader submits that he has not received any instructions. Hence, this Court is not inclined to adjourn the matter any further, but deems it appropriate to dispose of the writ petition with the following directions:
"As along as the alleged D-Form pattas granted in favour of the petitioners are in force and the petitioners are in possession of the lands, their possession and enjoyment over the lands shall not be interfered with unless and until the authorities concerned, for any reason, cancel their pattas by following the due process of law." With the above direction, the writ petition is disposed of.
No order as to costs.
As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
