THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5381 of 2015 ORDER:

The case of the petitioner is that he purchased land admeasuring Ac.1-31 cents in Survey No.277-1A of Dhampetla village, Bathalapalli mandal, Ananthapuramu district, from one Devarakonda Krishna Murthy and other, vide registered Doc.No.1531/2014, dated 15.04.2014, and since then he is in possession and enjoyment of the same. With an intention to convert the said land, he filed an application dated 10.12.2014 before the 3rd respondent-Revenue Divisional Officer, Anantapuram, under Section 3(2) of the Andhra Pradesh Agricultural Land (Conversion for NonAgricultural Purposes) Act, 2006 (for short 'the Act') stating is readiness to pay the conversion fee as applicable under the Act. The grievance of the petitioner is that the 3rd respondent is not disposing the said application.

2. The petitioner's counsel submits that as per proviso to subsection (6) of Section 3 of the Act, if no order is passed on such request within the time stipulated therein, the required permission shall be deemed to have been given.

3. Learned Assistant Government Pleader, on the other hand, submits that he does not have objection for disposal of the writ petition, with a direction to the respondents to pass appropriate orders on the application said to have been submitted by the petitioner.

4. Recording the submission, the writ petition is disposed of, directing the 3rd respondent to dispose of the application dated 10.12.2014 submitted by the petitioner, within a period of 15 days

from the date of receipt of a copy of this order, in accordance with law. The petitioner is directed to place a copy of this order before the 3rd respondent and the same shall be construed as an intimation, to enable him to proceed with and to pass appropriate orders thereon. There shall be no order as to costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
