THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37410 OF 2018 ORDER :

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material on record.

When the matter is taken up, written instructions, dated 12.10.2018, furnished by the Station House Officer, Miryalaguda II Town Police Station, Nalgonda District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under: "It is submitted that the petitioner has filed a private complaint before the court of Hon'ble JFCM at Miryalaguda against the unofficial Respondents 4 to 7 herein inter aria stating that all the accused persons tortured and abated the son of the petitioner and harassed, due to which his son committed suicide, thus all the accused persons are liable to be punished u/s 420, 306, 109, 201, 384, 506 IPC.

It is submitted that on reference from the Hon'ble Court vide Dis.No.529/2018, dated 20.6.2018, a case in Crime No.142/2018 u/s 420, 306, 109, 201, 384, 506 IPC, Sec.156

(3) Cr.P.C. of Miryalaguda II Town PS was registered on 17.7.2018 against the unofficial Respondents 4 to 7 herein and took up for investigation. The unofficial Respondents 4 to 7 herein are Al , A2, A3 and A4 in the Crime.

It is submitted that during the course of investigation, the complainant was examined as L.W.1 and recorded his statement. Later, visited the scene of offence, observed it and brought the same in Crime Detail Form. During the course of further investigation, as many as 11 witnesses were examined and recorded their statements.

The case is pending investigation for examination of some more witnesses and collection of evidence. It is submitted that fair and impartial investigation is conducting in the matter and no malafides can be attributed to the same. It is submitted that based on the investigation, appropriate report will be filed before the concerned Court.

It is submitted that the petitioner herein without knowing the above facts filed the present writ petition alleging that the Police are not taking any action in Crime No.142/2018 u/s 420, 306,

109, 201, 384, 506 IPC, Sec. 156 (3) Cr.P.C. of Miryalaguda II Town PS. With regard to providing police protection to the petitioner, it is submitted that, the said allegation Ms been made only for the purpose of the writ petition. The petitioner is not having any life threat as alleged".

By placing on record the above written instructions, Writ Petition is disposed of, with a further direction to the respondents to complete the investigation and file a final report, as expeditiously as possible.
