ORDER:

Petitioner claims to be owner and in possession and enjoyment of land to an extent of Ac.0.18 cents in Sy.No.8 of Meredubaka village, Kukkunur Mandal, West Godavari district. This writ petition is filed praying to declare the action of respondents, particularly 3rd respondent in not considering the representation of petitioner dated 01.07.2018 to pay compensation to him and not to entertain the claim of 6th respondent for payment of compensation and in not furnishing him the copies of notifications and notices issued in connection with acquisition of his land as illegal and arbitrary.

The initiation of land acquisition proceedings and the consequential steps taken by the competent authority are not under challenge.

When the matter is taken up for consideration, learned Government Pleader, on instructions, would submit that award was passed on 21.03.2017 in favour of 6th respondent on the land claimed by petitioner and compensation was credited to the account of 6th respondent on 25.03.2017, whereas petitioner gave notice on 01.07.2018 claiming for payment of compensation to him and not to pay compensation to the 6th respondent, by which date, award was passed and compensation was paid to 6th respondent. In view of the above submission of learned Government Pleader, question of respondents considering the said request of petitioner and alleging in action on their part does not arise. Since award was already passed, which is not under challenge, and

compensation was already paid, no relief as sought for by the petitioner can be granted. If petitioner has any grievance against 6th respondent claiming himself as owner and receiving compensation, he has to work out his remedies as available in law. Writ Petition is dismissed accordingly. Pending miscellaneous petitions shall stand closed.
