CONTEMPT CASE No.840 OF 2015 ORDER:
As it was vehemently contended that even though the document was presented, the concerned Sub-Registrar is not receiving the document and that though the document was sent through registered post on 03.03.2016 and was received, so far no further communication was given to the petitioners, contempt case was admitted.
2. Learned Government Pleader submits that though registered post was sent, the registered post cover contained only whitepapers and there was no document enclosed. Having noticed that there was no document enclosed, the Officer has made endorsement to that effect in the acknowledgment card. Learned Government Pleader submits that unless document is presented, no action can be taken and, therefore, respondents have not committed contempt as alleged. Copy of the postal cover along with acknowledgement is submitted to the Court and the same is taken on record.
3. As seen from the endorsement, Officer has clearly endorsed that cover does not contain the document. Such endorsement was made on 05.03.2016. Petitioners might have received the acknowledgement before 21.04.2016, when this contempt case was taken up and was admitted.
4. Petitioners abused process of Court by falsely alleging non-compliance of the orders even though document was not presented to the Sub-Registrar. Therefore, it cannot be said that respondents have violated the orders of this Court warranting continuation of the proceedings under the Contempt of Courts Act, 1971. Contempt Case is accordingly closed. Miscellaneous petitions if any pending shall stand closed. No costs. __________________________ JUSTICE P.NAVEEN RAO kkm
