THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3705 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure, 1973 by the petitioner/victim seeking to quash the proceedings in Crime No.42 of 2016 on the file of Hussaini Alam Police Station, Hyderabad.

2. Heard and perused the material available on record.

3. The aforementioned crime was registered under the head "Woman Missing" basing on a complaint given by respondent No.1/de facto complainant, who is the father of the petitioner.

4. The petitioner - Hajeera Begum, who is missing from the de facto complainant's house, appeared before this Court today along with her husband Mohammed Merajuddin. She also produced a marriage certificate in proof of their marriage. Admittedly, the marriage between the petitioner and Mohammed Merajuddin was performed as per their wish.

5. Learned counsel for the petitioner submitted that Merajuddin's father was called by the police to the police station and he was detained in the police station and hence, he prays to stay the further proceedings in the aforementioned crime.

6. Considering the facts and circumstances of the case and in view of the fact that the petitioner and Merajuddin are newly married and they also produced their marriage before this Court, the respondent police are directed to enquire into the complaint as well as the petitioner and Merajuddin and also verify the marriage certificate and dispose of the case expeditiously in accordance with law without

arresting any of the persons connected with this case. In the event of necessity, the police are directed to issue notice to the petitioner for her appearance before the Investigating Agency for the purpose of investigation. On issuance of such notice, the petitioner shall appear before the Investigating Agency and give an undertaking as to her future appearance as and when required by the Investigating Agency for the purpose of investigation.

7. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
