The Court made the following:

ORDER:

The petitioner, who has a serious dispute of title with respondent Nos.6 to 8 in respect of the property in question, has resorted to filing this Writ Petition, evidently, to see that a tiny shed raised by the said respondents is removed.

As could be seen from the averments contained in the affidavit, filed in support of the Writ Petition, dispute regarding title is the motive behind filing this Writ Petition. Therefore, this Court is not inclined to entertain this Writ Petition for adjudication as to whether a small shed raised by respondent Nos.6 to 8 was illegal or not. If the petitioner is interested in claiming rights in respect of the property over which respondent Nos.6 to 8 have raised the shed, he shall approach the civil Court of competent jurisdiction for declaration of his rights over the said property. Subject to the liberty given to the petitioner as above, the Writ Petition is dismissed.

As a sequel to dismissal of the Writ Petition, W.P.M.P.No.12536 of 2014 shall stand dismissed as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 23rd November, 2015 DR
