THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.31734 OF 2013 ORDER:

Heard the learned counsel for the petitioners and the learned GP appearing for respondent Nos. 1 to 3. 2.

The prayer sought in the Writ Petition is as under: "to issue a writ, order or direction, more particularly one in nature of Writ of Mandamus challenging the action of 3rd respondent and his Police Constables in interfering into the civil disputes between the petitioners and 4th respondent directing the petitioners to settle the matter by paying amount as demanded by the 3rd respondent is illegal, arbitrary and also violation of principles of natural justice and also lack of jurisdiction and consequently direct the respondents Police not to interfere into the civil disputes between the petitioners and 4th respondent in any manner."

The basic grievance of the petitioners against respondent Nos. 1 to 3 is that they are forcing the petitioners to settle the matter with respondent No.4.

Respondent No.3 filed a counter affidavit denying the averments made in the affidavit filed in support of the Writ Petition stating that respondent No.3 neither harassed the petitioners nor threatened or interfered with their personal life and liberty. Respondent No.3 has nothing to do with the civil

dispute between the petitioners and respondent No.4. It is also specifically stated that as of now, no criminal cases are registered against the petitioners and respondent No.4 and as such, the question of interference in the alleged civil dispute will not arise. They never directed the petitioners to settle the matter by paying amount to respondent No.4.

In the light of the above, this Court is of the opinion that no further orders are required in the Writ Petition. 6.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
